After looking at the redesign for how these games are made available on Xbox, it looks like Microsoft is getting ready to transition into a catalog style system. That means the games will only be available as long as you keep your gold account intact, as opposed to actually owning them for free.
It isn't in place yet, but keep an eye out on how they proceed.
