^ Sort of. With a pirated copy upgrade it's still not legit, may still become disabled at some point in the future from an OS patch or the prior patch(es) the pirate used to keep the OS happy may no longer work.
The pirate might then be able to find a new patch or hack, but then if that exists it's still a hacked OS, that you were getting (code) from MS as before but with the 3rd party hack added still.
In short MS isn't giving the upgrade to people with pirated copies, they merely haven't caused the installer to try to detect piracy and stop the install, while the OS itself still has its own piracy detection built in.

for a year.. if i remember right they offer the same deal to people with pirated copies of windows too.
